Notice on Issuing the Measures for the Administration of Green Building Labels in Hebei Province
Chapter I General Provisions Article 1 In order to regulate the management of green building labels and promote the high-quality development of green buildings in Hebei Province, these Measures are formulated in accordance with the relevant provisions of the "Regulations on Promoting the Development of Green Buildings in Hebei Province" and the "Green Building Label Management Measures" of the Ministry of Housing and Urban-Rural Development (Building Standard Regulations  No. 1) and in combination with the actual conditions of the province.
Measures for the Administration of Green Building Labels in Hebei Province
Chapter 1 General Provisions
Article 1 In order to standardize the management of green building labels and promote the high-quality development of green buildings in Hebei Province, these Measures are formulated in accordance with the relevant provisions of the Regulations on Promoting the Development of Green Buildings in Hebei Province and the Measures for the Administration of Green Building Labels of the Ministry of Housing and Urban-Rural Development (Building Standards  No. 1).
Article 2 The term "green building logo" as mentioned in these Measures refers to the information signs that indicate the star level of green buildings and contain performance indicators, including signs and certificates. The green building logo is unified by the Ministry of Housing and Urban-Rural Development, the certificate is made by the granting department, and the sign is made by the applicant according to different application scenarios.
The third green building logo is awarded to industrial and civil buildings that meet the green building star standard.
Article 4 The stars of the green building logo are divided into three levels from low to high: one-star, two-star and three-star.
Article 5 The Provincial Department of Housing and Urban-Rural Development is responsible for the identification and awarding of two-star green buildings, guiding and supervising the work of green building labels in various cities, and recommending three-star green building projects to the Ministry of Housing and Urban-Rural Development.
The competent departments of housing and urban-rural construction in each district city (including Dingzhou and Xinji) and xiong'an new area are responsible for identifying one-star green buildings and awarding them with marks.
The reporting unit can declare the green building logo at any time, and the competent department of housing and urban-rural construction will organize experts to carry out the review in batches according to the reporting situation.
Article 6 The following standards shall be adopted for the identification of star-rated signs for green buildings:
The "Green Building Evaluation Standard" (GB/T50378) shall be adopted for the identification of three-star signs for new civil buildings in (I), and the "Green Building Evaluation Standard" (DB13(J)T8352) shall be adopted for the identification of two-star or one-star signs;
(II) industrial buildings adopt the Evaluation Standard for Green Industrial Buildings (GB/T 50878);
(III) existing buildings adopt the Evaluation Standard for Green Renovation of Existing Buildings (GB/T 51141).
Article 7 The Provincial Department of Housing and Urban-Rural Development is responsible for establishing a database of green building experts in Hebei Province. The competent departments of urban and rural housing construction in each city may establish a green building expert database at the corresponding level according to the work needs.
Experts should be familiar with the national and Hebei Province green building standards, understand and master the relevant technical requirements of project planning, design, construction, etc., have good professional ethics, have deputy senior technical titles or above, or obtain relevant professional qualifications.
Two-star Green Building Logo Evaluation Experts shall select experts from Hebei Green Building Expert Database to form an expert group; One-star green building logo evaluation expert, provincial green building expert database experts shall not be less than 60%. The identified experts shall consist of 7-9 lists and shall not have an interest in the reporting unit.
Chapter II Declaration and Review Procedures
Article 8 The declaration of green building labels shall follow the principle of voluntariness, and the identification of green building labels shall be scientific, open, fair and just.
Article 9 The identification of green building signs shall be subject to declaration, recommendation, review, publicity, and publication. The review includes formal review and expert review. Article 10 A green building project shall be declared through the national green building identification management information system.
The Provincial Department of Housing and Urban-Rural Development and the competent departments of housing and urban-rural construction of each city can log in to the National Green Building Logo Management Information System to carry out green building logo review, recommendation, and identification according to their management authority. Projects that fail to pass the system shall promptly record the identified information into the system. Article 11 The declaration of green building signs shall be made by the project construction unit, operation unit or owner unit, and relevant units such as design, construction and consultation shall be encouraged to participate in the declaration. The project applying for green building logo shall meet the following conditions:
(I) carry out design, construction, operation and transformation in accordance with relevant national or local standards such as "green building evaluation standard";
(II) has passed the completion acceptance record of construction project. Article 12 The reporting unit shall provide the reporting materials according to the following requirements, and shall be responsible for the authenticity, accuracy and completeness of the materials. The application materials shall include the following contents:
(I) green building logo application form and self-assessment report;
(II) project approval and other relevant documents;
(III) application unit introduction, qualification certificate, unified social credit code certificate, etc.;
(IV) drawings, reports, calculations, pictures, videos and other technical documents related to identification;
(V) a letter of commitment to report the operating data of the main green performance indicators every year. If the declared project of
is commercial housing, the fourth material of the preceding paragraph also includes the quality guarantee and instruction manual of commercial housing with contents such as the grade of green building, energy-saving measures, warranty period of water-saving facilities and equipment, protection requirements, etc. in accordance with Article 18 of the regulations of Hebei Province on promoting the development of green buildings.
Article 13 The competent department of housing and urban construction shall conduct a formal review of the declared and recommended green building logo projects, and may also entrust a technical support unit to conduct a formal review of the declared and recommended green building logo projects in combination with work needs. During the formal review, the declared unit may be required to supplement the materials once. The main contents are as follows:
(I) whether the application units and projects meet the application conditions;
(II) whether the application materials are complete, complete, accurate and effective.
Article 14 After the formal review is passed, the competent department of housing and urban-rural construction shall organize expert review, review the performance of green buildings in accordance with the green building evaluation standards, and determine the level of green buildings. For the technical content of the project that cannot be determined in the review, it may Organize experts to conduct on-site verification.
Article 15 After the expert review is completed, the competent department of housing and urban construction shall publicize it on the portal website. The contents of the publicity include the project location, type, name, reporting unit, green building star rating and key technical indicators. The publicity period shall not be less than 7 working days. Signed written opinions on public projects must verify the situation and deal with objections. Article 16 For projects with no objection to publicity, the competent department of housing and urban-rural construction shall issue an announcement and grant a certificate.
Article 17 The number of the green building identification certificate shall consist of the regional number, star rating, building type, year and serial number of the project identified in the current year, with "-" connecting in the middle. According to the order of administrative divisions, Hebei region is numbered 03, and the building type codes are public building P, residential building R, industrial building I and mixed functional building M respectively. For example, the first 3-star public building project recognized by Hebei in 2021 has a certificate number of NO.03-3-P-2021-1.
Chapter III Logo Management
Article 18 The competent department of housing and urban construction shall strengthen the construction of the supervision mechanism for the operation of the power to restrict the identification of green building logos, scientifically design the work flow and supervision methods, clarify the management responsibilities and supervision measures, and effectively prevent and control the risks of clean government. Experts participating in the identification of green building labels should adhere to fairness and justice and avoid declaration projects that have a joint and several relationship with them. Violations of review regulations and review criteria shall be included in the personal credit record and removed from the expert pool, depending on the circumstances. If the construction unit or user of the project has any objection to the determination result, it may apply for administrative reconsideration or file an administrative lawsuit according to law. Article 19 The project operation unit or owner that has obtained the green building logo shall strengthen the operation management of the green building, strengthen the comparison between the operation index and the star index of the declared green building, and report the main annual operation index to the green building logo management information system every year.
Article 20 If the competent department of housing and urban construction finds any of the following problems in obtaining the green building logo project, it shall put forward a rectification request within a time limit, and the rectification period shall not exceed 2 years:
(I) project is lower than the star level of the recognized green building;
The main performance of the (II) project is lower than the index of the green building logo certificate;
(III) uses the green building logo for false propaganda;
(IV) have failed to truthfully report the main indicator data for more than two consecutive years.
Article 21 The competent department of housing and urban construction shall revoke the green building logo and withdraw the sign and certificate if it finds any of the following problems in the 1. two-star green building logo project:
(I) the rectification period has not been completed;

(III) Major safety accident occurred.
Before making a decision to revoke the 1. two-star green building logo, the housing and urban-rural construction department shall inform the reporting unit in advance that it has the right to make a statement and defend itself. The facts and evidence submitted by the reporting unit shall be reviewed, and the facts and evidence shall be established., Should be adopted. If it is not adopted, the reasons shall be given. The revocation decision shall be delivered to the reporting unit in a timely manner and announced to the public.
Chapter IV Supplementary Provisions
Article 22 The pre-evaluation of engineering projects may refer to these Measures for the pre-evaluation of green buildings after the completion of the construction drawing design of the project, but no logo is granted.
Article 23 These Measures shall come into force as of September 15, 2021. The Implementation Plan for the Evaluation and Identification of One or Two-Star Green Buildings in Hebei Province (Ji Jianke  No. 206) shall be abolished at the same time.
